Terms of Service

This Terms of Service Agreement (the "Agreement") is a legally binding contract between AmbitionHost ("AmbitionHost", "us", "we") and you ("Customer", "you", "your"). By purchasing or using our services, you agree to be bound by this Agreement. Along with this Agreement, the following policies are an integral part of this agreement:

• Refund Policy

Account Eligibility, Security & Management

By registering, you represent you are at least eighteen (18) years of age. You must provide accurate and current information. You are solely responsible for all activities in your account and for maintaining the security of your password.

It is your responsibility to ensure that scripts and programs installed under your account are secure and permissions are set properly. You are responsible for all actions taken under your account, including the compromise of credentials.

Any dedicated IP order is subject to IP justification. Policies may change to comply with regional internet registries (IRINN, ARIN, RIPE).

Changing the main domain associated with a hosting account will incur a $10 fee for each change.

Domain Name Services

As a reseller, our domain services are subject to the following specific conditions:

1. Availability & Pricing: We do not guarantee a domain you search for can be registered. Pricing may vary and does not apply to premium aftermarket domains.
2. Non-Real-time Registration: Our registration system is not instant. Activation can take up to 48 hours. Due to this delay, a domain might be ordered by multiple users; final ownership will be granted to the user who completes payment first. In case of simultaneous payments, the domain may be deleted if the parties cannot agree on ownership.
3. Non-Refundable: Domain registrations, transfers, and renewals are final and non-refundable. Any administration charges are also non-refundable, regardless of the outcome. Please double-check your domain name before purchase.
4. ICANN Transfer Lock: In accordance with ICANN policy, all new domain registrations and transfers are locked for 60 days, during which they cannot be moved to another registrar.
5. Country-Specific Domains (.in, etc.): Certain country-code domains (ccTLDs) like `.in` require additional documentation to prove eligibility, as mandated by their respective registries (e.g., NIXI for `.in` domains). You agree to provide any required Know Your Customer (KYC) documents or other information upon request. Failure to do so may result in your domain being suspended or canceled.
6. Disputes and Cancellation: Any dispute between you and any other person regarding your domain must be resolved between the parties concerned. We are entitled, at our discretion and without giving any reason, to withhold, suspend, or cancel the domain if a dispute arises.
7. Expiration and Renewal: We are not responsible for your domain once it expires. Unlocking a domain or getting an AUTH code is not possible for expired domains until they are renewed with us. A redemption fee (₹8,000 to ₹15,000) may apply to restore a domain after expiration.
8. DNS Management: Our panel currently only supports changing nameservers. For advanced DNS management (A records, CNAME, etc.), we recommend using a free third-party service like Cloudflare.
9. Free Domains: Any free domain offer is tied to a specific hosting plan. If you do not renew the hosting plan, you must renew the domain separately at the standard rate.
10. Promotions: Promotional prices are valid for new registrations only. Using them for renewals or transfers will result in your order being canceled.
11. Right to Cancel: As we are a reseller and rely on third-party systems, a domain can be suspended or canceled at any time, with or without notice due to registrar-level issues. In such a rare event, our liability is limited to providing you with a similar alternative domain for free.

User Content & System Monitoring

You may be able to upload, store, publish, and distribute information, text, photos, and other content ("User Content"). You are solely responsible for all User Content. AmbitionHost exercises no control over, and accepts no responsibility for, User Content or the content of any information passing through our network.

We do not monitor User Content, but reserve the right to take corrective action (including removal of content or account suspension) without refund if you violate this Agreement.

Website Migrations

Our website migration service is provided as a courtesy. Our team will make every effort to help move your website to us, but we do not make any guarantees regarding the availability, possibility, or time required to complete an account transfer.

Billing and Payment

You agree to pay for services in advance. Services are billed on an automatically recurring basis unless a cancellation request is submitted. Invoices are generated 7 days before the due date.

An invoice outstanding for more than two (2) days may result in account suspension. If unpaid for seven (7) days, the account will be terminated and all data, including backups, will be permanently deleted.

We reserve the right to charge a 10% late fee on overdue invoices. Misuse of credit cards or initiating a payment dispute is a violation of this Agreement and may incur a $75 chargeback fee.

Service Cancellation & Termination

Cancellation by Customer

You must submit a formal cancellation request from your client dashboard. All data is deleted upon cancellation. For monthly services, cancellation must be submitted 7 days before the renewal date to avoid charges for the next month.

Termination by AmbitionHost

We may terminate this Agreement if you break any of these terms and fail to correct the breach within seven (7) days of a written notice from us. We may also terminate the agreement forthwith without notice if you fail to pay sums as they become due, or if you are a company that goes into insolvent liquidation. On termination, we are entitled to immediately block your website and remove all data. We may, at our discretion, hold such data for a period to allow you to collect it at your expense, subject to full payment of any outstanding amounts.

30-Day Money-Back Guarantee

A 30-day money-back guarantee is available for first-time customers on new shared and VPS hosting accounts with a yearly billing cycle. It does not apply to domains, setup fees, or accounts that have violated our terms. You must be a customer for 20-30 days to be eligible. Any violation of this agreement will waive your right to a refund.

Acceptable Use Policy (AUP)

Resource Usage and Abuse

Any account connecting to a third-party network without authorization or causing an abuse report will be suspended. If malicious content is not removed after notification, we reserve the right to leave services disabled. We follow this abuse schedule:

• First notice: No charge. Service suspended if not addressed in 12 hours.
• Second notice: $5 penalty.
• Third notice: Account Termination.

Excessive CPU, Bandwidth or Disk usage will be reviewed. Space may not be used for storage (e.g., offsite backups). If your hosting account storage increases by more than 20GB, we may migrate your account to other servers.

Prohibited Materials

The following materials are strictly prohibited on our servers:

• Topsites
• IRC Scripts and Bots
• IRCD (IRC servers)
• Proxy Scripts, Anonymizers (includes Shadowsocks)
• Image Hosting Scripts (similar to Photobucket or Tinypic)
• AutoSurf, PTC, PTS, PPC sites
• IP Scanners
• Bruteforce Programs, Scripts, and Applications
• Mail Bombers and Spam Scripts
• Banner Ad services (commercial banner ad rotation)
• File Dump and Mirror Scripts (similar to Rapidshare)
• Commercial Audio Streaming (more than one or two streams)
• Escrow and Bank Debentures
• High Yield Interest Programs (HYIP) or Related Sites
• Investment Sites (FOREX, E-Gold Exchange, Second Life/Linden Exchange, Ponzi, MLM, Pyramid Scheme)
• Sale or distribution of any controlled substance without prior proof of appropriate permit(s)
• Prime Banks Programs
• Lottery, Gambling Sites
• MUDs, RPGs, PBBGs
• Hacker focused sites, archives, programs
• Sites promoting illegal activities
• Forums and/or websites that distribute or link to warez, pirated, or illegal content
• Bank Debentures, Bank Debenture Trading Programs
• Fraudulent Sites (Including, but not limited to sites listed at aa419.org and escrow-fraud.com)
• Mailer Pro, Push button mail scripts (permission required)
• Broadcast or Streaming of Live Sporting Events (UFC, NASCAR, FIFA, NFL, etc.)
• Tell A Friend Scripts
• Anonymous or Bulk SMS Gateways
• Bitcoin or Any Virtual Currency Miners
• PayDay Loan Sites (including any site related to PayDay loans, PayDay loan affiliate programs, etc.)
• File hosting or using hosting for backup purposes.

Disclaimers and Limitation of Liability

Uptime Guarantee

We provide a 100% uptime guarantee for shared/premium servers, excluding planned maintenance, acts of God, or third-party attacks. If this guarantee is not met, you may receive one month of credit on your account upon request.

Backups and Data Loss

Your use of our services is at your sole risk. Our backup service runs daily and is provided as a courtesy which may be terminated at any time. We are not liable for any data loss. You are solely responsible for maintaining your own remote backups.

HIPAA Disclaimer

Our services are not HIPAA compliant and are prohibited for storing "protected health information."

General Disclaimer

AmbitionHost is not responsible for any damages your business may suffer. We do not make implied or written warranties for any of our services and deny any warranty or merchantability for a specific purpose. This includes loss of data from delays, non-deliveries, wrong delivery, and any service interruptions.

Indemnification

You agree to indemnify, defend, and hold harmless AmbitionHost, our affiliates, officers, directors, employees, and agents from and against any breach by you of these terms and any claim brought against us by a third party resulting from your use of the Services.
